Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner Rakesh Brahma praying for releasing him on bail in connection with Kokrajhar Police Station Case No.09/2025. Page No.# 2/2 3. On 08.01.2025, at mid night, two groups of young person had a fight, where some boys sustained injuries. Each group of boys had lodged two FIR. 4. Mr. Das submits that one injured person sustained grievous injuries like fracture and lacerated injury over parietal region. 5. The FIR lodged against the present petitioner also alleges loss of teeth by particular boy. 6. The petitioner has already spent 39 days in judicial custody. 7. In spite of having some materials in the Case Diary, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. 8. The Bail application of the petitioner is allowed. 9. Accordingly, the petitioner Rakesh Brahma, who was arrested in connection with Kokrajhar Police Station Case No.09/2025 shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kokrajhar. 10.
