This is the Second Bail Application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 264/2024, registered at Police Station : Purani Basti, District - Raipur (C.G.) for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The earlier bail application of the applicant has been rejected by this Court in MCRC No. 5919 of 2024 vide order dated 23.07.2024 on the ground that the the applicant has previous criminal antecedents under the NDPS Act and IPC which is pending. The case of the prosecution, in brief, is that on 31.12.2023 the Police of Police Station Purani Basti, District Raipur received a secret information from the informant and on the basis of said information Police has seized 10.60 Kgs of Ganja from the possession of the present applicant. Thereafter, the offence has been registered against the present applicant. 4. Learned counsel for the applicant states that he wants to withdraw the present bail application as the fact that the father of the applicant has died on 20.01.2025 and further last rights of the applicant’s father is going to be held on 29.01.2025 and 01.02.2025, therefore he wants to temporary bail to attend the Shrad and Teravi on 29.01.2025 and 01.02.2025, since, these dates have already passed, the purpose of the bail application has become infructuous. 5.
