This is an application preferred by the applicant for condonation of delay of 751 days occurred in filing the Criminal Appeal Learned advocate for the applicant states that the delay is the ground that the applicant was suffering from mental and emotional distress due to demise of his wife who succumbed to COVID-19 and the applicant remained in the state of depression. Having heard learned Counsel for the respective parties. Considering the averments made in the application, it appears that the delay is sufficiently explained. Therefore, delay deserves to be condoned. Accordingly, delay is condoned. The Criminal Misc. Application stands disposed of. Rule is made absolute.
