ORAL ORDER
1. The petitioner is before this court seeking for the following reliefs:
"a. Quash the. Tender Notification bearing Reference No. KMF/2025-26/IND1393 (ANNEXURE - A) for availing used cooking oil from Nandini Milk Products for a period of one year, issued on 29/04/2025 at KMP Director Purchase Karnataka Co-operative Milk Producers Federation Ltd., Bengaluru Central Office. b. Direct the Respondent No. 3, to conduct fresh Tender proceedings in accordance with law, with a word of caution, that no authority whomsoever should permit or tolerate any interference in the entire process, whomsoever of any nature whatsoever and the qualifying criteria and the process of participation should be scrupulously adhered to in all aspects. c. Direct the Respondent No.3 to permit/allow the Petitioner to participate in the tender process d. Direct the Respondent No.3 resume the Extension order dated 20/02/2025 (ANNEXURE - D) passed by the Respondent No.3. e. The petitioners has no other alternative or efficacious remedy. Hence knocking the doors of this Hon'ble court. f. To grant such other reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case, including award the cost of these proceedings in the interest of justice and equity."
2. Memo dated 03.11.2025 has been filed by the
learned counsel for the petitioner, which reads as under:

"1. The above Writ Petition was filed under Article 226 of the institution of India, inter alia, praying for quashing of Tender Notification bearing Reference No. KMF/2025-26/IND1393 issued on 29/04/2025.
2. In view of the above, the Petitioner do not wish to press the present Writ Petition at this stage and seek permission from this Hon'ble Court to withdraw the same, with liberty to file a fresh appeal under Section 16 of the KTPP Act before the competent appellate authority, without prejudice to the rights and
contentions of the Petitioner. The withdrawal is sought bona fide and no prejudice whatsoever would be caused to the Respondents or any other party by granting such permission.
3. It is submitted that granting liberty to file a fresh appeal would serve the ends of justice and prevent multiplicity of proceedings."
3. Accepting the said memo, the petition is dismissed as withdrawn.
