: This is the first petition, preferred under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail in FIR No.31, dated 07.02.2025, under Sections 22, 29 of ND&PS Act 1985 and Section 223 of Bharatiya Nyaya Sanhita, 2023, registered at Police Station City South Moga, District Moga.

On 07.02.2025, on the basis of a secret information, one Rajinderpal Singh @ Shani was apprehended and 1950 loose intoxicating tablets of Tramadol along with 70 strips of capsules each containing 10 capsules (total 700 capsules) mark Pregabalin IP 300 mg NEURO-300, B.No.SF210072, MFG.MAR. 20236, EXP.FEB. 2025, were recovered. On the basis of a disclosure statement suffered by the said Rajinderpal Singh, the present petitioner was apprehended on
08.02.2025.

Learned counsel for the petitioner submits that the petitioner was falsely implicated. He submits that he had no connection with Rajinderpal who is in custody. He further submits that the petitioner has no antecedents and has no criminal background. and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.
4. Per contra, learned State counsel has opposed the bail application. However, she concedes that as per the instructions received by her, the petitioner is not involved in any other criminal case. On a pointed query raised by the Court, learned State counsel has not been able to point out any connection, at this stage, with the main accused.
5. I have considered the submissions made by learned counsel for the parties.
6. Main accused Rajinderpal was apprehended with a commercial quantity of Tramadol. He is already in custody. The petitioner was arrested on the basis of a disclosure statement suffered by the said Rajinderpal. No recovery was made from the petitioner. Final report has already been submitted and trial will take a sufficiently long time. There are no criminal antecedents of the petitioner, and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer.
7. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, Moga.
