Heard Mr. M. Nath, learned Senior Counsel assisted by Mr. A. Bhattacharjee,
learned counsel for the applicant. Also heard Mr. NK Sarma, learned counsel for the respondents no. 1 to 3/petitioners in WP(C) No.6968/2024 and Mr. U Ghosh,
learned counsel for the Health Department. By filing this application the applicant, namely, All Assam Auxiliary Nurse Midwife and Lady Health Supervisor Service Association seeks impleadment as party respondent no. 7 in WP(C) No.6968/2024. In the writ petition the writ petitioners have challenged the resolution dated 05.11.2024 to the effect that the posts of Public Health Nurse (PHN)/District Public Health Nurse (DPHN) and Deputy Director Nursing under Director of Health Services are to be filled up by way of promotion on seniority basis from the ANM Cadre. It is submitted by the applicant that this resolution adopted was on the basis of a memorandum submitted by the applicant association. However, the writ petition was filed without arraying the applicant as a party respondent as this Court had passed an interim order on 20.12.2024 staying the operation of the minutes. Since the minutes were adopted on the basis of the memorandum filed by the applicant,
Page No.# 4/4 the applicant is an affected party and as such, the applicant has filed this application seeking impleadment as party respondent no.7 in WP(C) No.6968/2024. The respondents did not object to the prayer made. Accordingly, Interlocutory Application stands allowed. The applicant, namely, All Assam Auxiliary Nurse Midwife and Lady Health Supervisor Service Association is arrayed as party respondent no.7 in WP(C) No.6968/2024.
