ORAL ORDER
The petitioner is seeking to enlarge him on anticipatory bail in Crime No.61/2025 of Mandya East Police Station, registered for the offence punishable under Section 316(2), 318(2) of the Bharatiya Nyaya Sanhita (BNS), 2023.
2. Heard Learned counsel for the petitioner and learned High Court Government Pleader for the State and perused the material on record.
3. The first informant working as a security guard has alleged that, the accused who is also working as a security guard, about a year and half prior, promising that he would arrange 'D' group job in District Hospital, Mandya making him to believe that he knows the Director and the Superintendent of the hospital etc., received a sum of Rs.65,000/- from him, a sum of Rs.70,000/- from one Jyothi and a sum of Rs.40,000/- from one Deepthi and thereafter, cheated them, without providing any job and not returning the money. Further, when they requested him to return the amount, he threatened them

by saying that there is no proof for having paid the amount and he would file a complaint against them under the Atrocities Act.
4. According to the complainant, with a promise of providing a 'D' group employment in the District Hospital, Mandya, accused received the amount from the complainant and two others between 21.03.2024 and
26.12.2024. Admittedly, there is no document to show the transaction. It is stated that on 08.06.2025, the complainant being depressed, took some tablets (30 Nos.) and he was admitted at District Hospital Mandya for treatment. It appears that, after his discharge from the hospital on 10.06.2025, complaint was lodged against the petitioner.
5. The prosecution has to establish the allegation against the petitioner in due course. The offences alleged are not punishable with the death or imprisonment for life. Petitioner has undertaken to cooperate with the investigation. Hence, the following:

ORDER Petition is allowed. Petitioner/accused in Crime No.61/2025 of Mandya East Police Station, Mandya, shall be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with a surety for the likesum. b) He shall co operate with the investigation of the case. c) He shall not tamper the prosecution witnesses. d) He shall be regular in attending the Court proceedings. b) He shall not commit any offence. c) If the above conditions are violated, Prosecution is at liberty to move for cancellation of bail.
