1. Heard Mr. K.K. Handique, the learned counsel for the petitioner. Also heard Ms. S.H. Bora, the learned Additional Public Prosecutor appearing for the

This application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has been filed by the petitioner, namely, Sankar Doley@Dharani Shankar Doley, who is aggrieved by the order dated 05.09.2019, passed by the Court of the learned Additional Sessions Judge, Biswanath, Assam in Sessions Case No. 219/2013, whereby the petitioner was declared as proclaimed offender.
3. The learned counsel for the petitioner has also submitted that the same Sessions Case has now been filed by the Trial Court, while issuing a standing non bailable warrant of arrest against the present petitioner.
4. The learned counsel for the petitioner submits that he is ready to fact the trial and he was not aware about the processes issued by the Trial Court against him.
5. Considering the fact that the Sessions Case, which has been filed is an old pending case of the year 2013, as well as considering the fact that the petitioner is ready to fact the trial, this criminal petition is disposed of with a direction to the present petitioner to appear before the Trial Court, i.e. the Court of the learned Additional Sessions Judge, Biswanath, Assam within a period of 15(fifteen) days from the date of this order and cooperate in the trial.
6. To facilitate his appearance before the Trial Court, the non bailable warrant of arrest issued against him shall be suspended for next 15(fifteen) days.
7. With the above observations, this criminal petition is disposed of.
