ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“.... to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the 31d respondent in not taking action on the petitioner's complaint dt-08-02-2020 though the complaint discloses cognizable offence is illegal, arbitrary and in violation of Principles of Natural justice and in violation of Art.14 of the Constitution of India and consequently direct the 3rd respondent to take appropriate action on the petitioner's complaint dt-08-02-2020 in the interest of justice ...”
Heard learned Assistant Government Pleader for Home appearing for respondent State. Perused the material on record. It is represented that learned counsel on record is no more.
As can be seen from the material on record, Pettiioner sought for a driecaton to respondent No.3 to take approrpatie action on the Petitioner’s complaint dated 08.02.2020 by directing respondent Police not to interfere int he civil disputes between the parties. Sri V.Farooq, learned Assistant Government Pleader for Home on instructions, would submit that basing on the complaint given by Petitioner, respondent, police conducted enquiry, wherein, it was revealed that there are civil disputes pending between the Petitioner and respondent No.4 and that the contents of the complaint is purely civil in nature and no crime is registered and would submit that this Court may pass appropriate orders by disposing of this Writ Petition. 3
In the light of the submissions made, this Writ Petition is disposed of. Respondent Police are directed not to interfere in the civil disputes pending between the parties except following due process of law. No order as to costs.
