Present criminal writ petition has been filed under Article 226 of the Constitution for issuance of a writ in the nature of mandamus directing official respondents to protect the life and liberty of petitioner at the hands of respondent Nos.5 & 6. Further prayer is for transferring the investigation of FIR No.91 dated 26.05.2025 (P-1), under Sections 333, 115(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’), registered at Police Station Sadar, District Sri Muktsar Sahib to any other independent Agency/Senior Police Officer. (2) Although, there is no formal notice of motion in this case; but this Court, on 13.06.2025, passed the following order:- GAGANDEEP 2025.07.08 19:10 I attest to the accuracy and authenticity of this document High Court, Chandigarh CRWP No.6346 of 2025 (O&M) -2- “Learned State counsel shall get instructions about the fate of representations dated 30.05.2025 and 04.06.2025 (P-2 & P-3) respectively. Posted for 07.07.2025. It is clarified that there is no formal notice of motion in this case.” (3) Today, in compliance of aforesaid order, reply by way of an affidavit dated 06.07.2025 of Sh. Naveen Kumar, DSP, Sub Division Sri Muktsar Sahib, on behalf of respondent Nos.1 to 4, has been filed. The same is taken on record. Copy thereof supplied to the opposite side. (4) Perusal of the aforesaid affidavit reveals that investigation of FIR No.91 dated 26.05.2025 (supra) is going on and the same shall be completed at the earliest. (5) In view of the above, no further directions are required to be issued in the present petition. Consequently, the same is hereby disposed off. (6) Needless to say that investigation shall be carried out in accordance with law preferably within eight weeks without there being influenced by the order of this Court.
