The present petition has been filed under Section 482 of BNSS, 2023 seeking anticipatory bail to the petitioner in a case bearing FIR No.32 dated 01.04.2025 under Sections 126(2), 221, 226, 262, 132, 351(2), 190 and 121(1) of BNS, 2023 registered at Police Station Sandaur, District Malerkotla, Punjab (Annexure P-1). 2. On 16.06.2025, following order was passed: “Petitioner prays for the grant of pre-arrest bail in a criminal case arising from FIR No.32 dated 01.04.2025, registered under Section 126 (2), 221, 226, 262, 132, 351 (2), 190 and 121 (1) of Bhartiya Nyaya Sanhita, 2023, registered at Police Station, Sandaur, District Malkerkotla. Learned counsel representing the petitioner relies upon an order dated 26.05.2025 passed in CRM-M-29476- 2025 vide which a co-accused of the petitioner has been granted the concession of bail. Notice of motion. On asking of the Court, Mr. Salil Sablok, Sr. DAG, Punjab, accepts notice on behalf of the State. List alongwith CRM-M-29476-2025 on 10.07.2025. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 482(2) BNSS, 2023.” 3. Learned State counsel, on instructions from SI Dilbar Singh, submits that in compliance of order dated 16.05.2025 passed by this Court, the petitioners have joined the investigation and are not required for further custodial interrogation. 4. Keeping in view the statement made by learned State Counsel, the order dated 16.05.2025, is made absolute. The petitioners shall abide by the terms and conditions enumerated in Section 482(2) BNSS, 2023 (Erstwhile Section 438(2) Cr.P.C.) 5. The petition is accordingly disposed of. 6. Nothing observed hereinabove shall be construed to be an expression of opinion by this Court lest it may prejudice the trial. The learned trial Court is directed to proceed with the trial on its own merits, strictly in accordance with law.
