Learned counsel for the respondent-B.S.A. has passed on instructions in the Court today, which are taken on record. Heard Mr. Achchhey Lal Tiwari, learned counsel for the petitioner, Mr. Kushmondeya Shahi, learned counsel for respondent-B.S.A. as well as learned Standing Counsel for the State. Learned counsel for the petitioner submits that the relief as prayed in prayer nos.1 and 2 has already become infructuous. He is only pressing relief no.3 regarding payment of salary. On the basis of instructions which are placed on record, learned counsel for respondent-B.S.A. submits that a salary has already been deposited in the account of the petitioner, therefore, nothing remains in the petition as the same has become infructuous. In view of the above, the present petition has become infructuous and is dismissed, accordingly.
