Deboleena Ghosh, …for the State. The petitioners seek to organise a peaceful sit-in demonstration in Y Channel, Dharmatala from December 27, 2025. Learned counsel for the State submits that the Y Channel, Dharmatala is very congested area and several other organizations are organizing demonstrations in and around the place. Also, due to advent Christmas and New Year, the place will be extremely crowded and shall not be feasible for organizing a sit-in demonstration. Learned counsel suggests that such demonstration may be organised at Ramlila Maidan on a weekend subject to compliance with all necessary formalities. The petitioners accede to the suggestion of location given by the State.
Upon consideration the submission made on behalf of the parties, this Court is of the view that the sit-in
2 demonstration may be organized by the petitioners at Ramlila Maidan from December 27, 2025 as prayed for by them subject to the following conditions: i) The participants in the demonstration shall not be more than one hundred at any point of time; ii) The sound system shall be within the permissible limits as prescribed by the Hon’ble High Court at Calcutta and the West Bengal Pollution Control Board; iii) Speeches capable of inciting violence, provocative speeches and abusive language will not be permitted; iv) The participants in the demonstration shall act in a manner to ensure that there is no damage to public property, assault on any government servant or any other digression of law; v) The participants shall act in a manner so as not to cause any inconvenience to the public at large; vi) No obstruction shall be created to free flow of traffic/vehicle movement; vii) Names of twenty volunteers should be furnished to the police authority in advance who shall be responsible for any violation of the order of this Court; viii) The volunteers shall provide their contact numbers before the police authority at the earliest; and ix) The participants shall disperse within one hour of conclusion of demonstration;
3 With the above directions, the writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
