This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the proceedings of Complaint Case No. 3760/9 of 2007, under Section 304A I.P.C., P.S.- Civil Line, District- Muzaffarnagar pending in the Court of learned Additional Chief Judicial Magistrate, Court No.1, Muzaffarnagar expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the complainant in the aforesaid case. It is further submitted that the said complaint case is pending since 2007 at the stage of evidence. It is further submitted that accused never cooperated with the trial Court and he took shelter of the Hon'ble Supreme Court and Hon'ble High Court on false grounds and also obtained some stay orders but however at present there is no stay order passed by any superior Court and the matter is still pending at the stage of evidence. Now the accused is appearing before the Court. The Court concerned is not taking proper interest to decide the said case. 4. I have considered the submissions and perused the entire record. 5. Since the matter is very old, the Court concerned is directed to close the proceedings of evidence after recording deposition of relevant witnesses and all endeavours shall be made for the expeditious disposal of the case preferably within a period of six months from today, keeping in view the heavy work load in the said Court. 6. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 7.
