Mr. S.K. Nailwal, Standing Counsel for the State of Uttarakhand. 3. Petitioners are residents of Village Shaukanagla, Bazpur, District Udham Singh Nagar. By means of this writ petition, they have sought the following reliefs:- “(i) To issue a writ order or direction in the nature of certiorari to quash the impugned Notification dated 8th October 1992, with regard to village Shauka Nagla, Pargana Bazpur, District Nainital passed by the Respondent no. 2 (ANNEXURE NO. 1) to the writ petition, and the respondents may kindly be directed to hear the version of the petitioner is the case concern. (ii) To issue a writ order or direction in the nature of mandamus to stay the effect and operation of the impugned Notification dated 8th October 1992. with regard to village Shauka Nagla, Pargana Bazpur, District Nainital (ANNEXURE NO.- 1) to the writ petition, till the pendency of this writ petition before this Hon'ble Court, and the respondents may kindly be directed to hear the version of the petitioner is the case concern.” 4. Learned State Counsel was asked to get instructions. Today, he has produced in Court letter dated 28.04.2025, issued by District Magistrate, Udham Singh Nagar to Commissioner and Secretary/ Director, Consolidation, Uttarakhand, which is taken on record. 2025:UHC:5175 5. Perusal of the said letter reveals that the process of consolidation of land in Village Shaukanagla, Tehsil Bazpur is complete and the notification has to be issued under Section 52(1) of Consolidation of Land Holdings Act, 1953. 6. Since the consolidation process is over and only notification under Section 52(1) of the aforesaid Act is to be issued, therefore, reliefs claimed in the writ petition cannot be granted, at this belated state. 7. The writ petition, thus, fails and is dismissed.
