JUSTICE ANU SIVARAMAN) This contempt of Court case is filed alleging criminal contempt as against the accused persons on the basis of the order dated 19.12.2023 in W.P.No.24716/2022. 2. Today, when the matter is called, all the accused persons are present before the Court. 3. Though the accused persons had initially filed counter affidavit in the matter and attempted to establish that there was no contempt as alleged, today, they have filed a joint affidavit tendering an unconditional apology. The relevant paragraphs of the affidavit read as follows: "1. We submit that we are the Accused in the present suo motu criminal contempt proceedings. During the year 2023-24 we were the elected office-bearers of the Veracious Vanivilas Flat Owners Association ("the Association"). We are fully conversant with the facts and are competent to swear this affidavit on behalf of ourselves and the Association. 2. We humbly submit that we have highest regards, respect and obedience to this Hon'ble Court and judicial - 4 - HC-KAR NC: 2025:KHC:52645-DB CRL.CCC No. 3 of 2025 process. At no point in time, we have or intended to disrespect this Hon'ble Court or any judicial proceedings. We tender unconditional apology for any of our conduct which has led to the present proceedings. 3. We respectfully submit this affidavit to place on record on oath our unconditional apologies and crave leave of this Hon'ble Court to kindly discharge us from these proceedings. 4. On 19.12.2023 the single bench of this Hon'ble Court, viewing the filing of the civil suit as an abuse of process, initiated these suo motu criminal contempt proceedings vide its order in W.P. No.24716/2022. 5. We respectfully submit that on 03.01.2024 Veracious Vanivilas Flat Owners Association craved leave of the Hon'ble Supreme Court in SLP (C) No.28401/2023 a liberty to pursue remedies in the pending civil suit filed by us. 6. We submit that on 06.06.2024 the entrance arch/pergola, which was the subject matter of the dispute in W.P. No.24716/2022, has been completely demolished by the Bruhat Bengaluru Mahanagara Palike (BBMP) and the same no longer exists. 7. We respectfully submit that the filing of W.P. No.24716/2022 and W.A. No.1426/2023 was explicitly mentioned in the plaint of O.S. No.26592/2023 as well as in SLP (C) No.28401/2023. - 5 - HC-KAR NC: 2025:KHC:52645-DB CRL.CCC No. 3 of 2025 8. We most respectfully submit that our actions were never intended to willfully disrespect the orders of this Hon'ble Court. We tender unconditional apology for any of our conduct which has led to the present proceedings." 4. Having heard the learned counsel on either side and having considered the unconditional apology tendered by the accused persons, we are of the opinion that in the facts and circumstances of the case, no further steps shall be taken in the contempt of Court case. 5.
