The allegations against the present petitioner that she took the prosecutrix to her house where uncle of the prosecutrix committed wrong acts upon her, however there is no evidence on record to connect the petitioner with the commission of alleged offence. In fact, as per the version in the FIR, the alleged occurrence took place in May, 2023, however, the factum of commission of the same was not disclosed by the prosecutrix, and it was after a delay of nearly 5 months that the instant FIR was registered. It is further submitted that the instant FIR was registered with mala fide motive, since the husband of the petitioner and the father of the prosecutrix, who are real brothers and are involved in a dispute.
