Supplementary affidavit filed today on behalf of the petitioners is taken on record. 2. The following prayers have been made in the present writ petition:- (a) Issue a writ, order or direction in the nature of mandamus command the state respondents neither demolish and destroy the petitioner's house, other constructions and foundations, situated in Village Dariyal Mustehkam, Tehsil Tanda, District-Rampur, nor evict them nor interfere in their peaceful possession. (b) Issue a writ, order or direction in the nature of mandamus command the state respondents to demarcate the Gata No.932K/1.3880 hect. situated in Village Dariyal Mustehkam, Tehsil Tanda, District-Rampur and construct the road in additional space in said gata. 3. As the dispute is essentially between two sets of private individuals in relation to an immovable property, therefore, we are not inclined to examine the same in exercise of writ jurisdiction. 4. At this stage, learned counsel for the petitioners prays for withdrawal of the writ petition with liberty to the petitioners to avail appropriate remedy under common civil law. 5.
