(ORAL) 1. This is a petition for anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in case bearing FIR No.37 dated 16.05.2025 (inadvertently mentioned as FIR No.35 in the impugned order) under Sections 304, 109, 191(3), 190 of BNS, 2023 and Sections 25/27 of Arms Act registered at Police Station Majitha Road, District Amritsar. 2. The case of the prosecution is that the petitioner was among 06 persons who had allegedly come to the park with their faces covered and attacked the complainant and his friends. They took money from the pocket of the complainant and one of the assailants fired a shot with his gun upon the complainant which hit him on his wrist. The petitioner is minor of 17 ½ years of age and is stated to be one of the persons who had participated in the aforesaid occurrence. This Court, vide order dated 12.06.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 482 BNS. 4. Learned State counsel has filed the short reply and on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 5. In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the investigating officer, the order dated 12.06.2025 granting interim bail to the petitioner is made absolute. 6. However, the petitioner shall abide by the conditions stipulated under Section 482, BNS. He shall also join investigation as and when called upon to do so. 7. The petition stands allowed.
