The challenge in this petition is made to the order dated 02.04.2025, passed by the respondent no.1 under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (“the SARFAESI Act”), by which police force was required to implement the order. Heard. At the very outset, the Court wanted to know as to why this petition should be entertained in view of alternate efficacious remedy under Section 17 of the SARFAESI Act? Learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to approach before the appropriate forum. He further seeks directions that till the petitioner approaches the appropriate forum, the operation of the impugned order may be stayed. The permission is accorded. The writ petition is dismissed as withdrawn. The operation of the impugned order shall remain in abeyance till 11.06.2025, so as to enable the petitioner to approach before the appropriate forum under Section 17 of the SARFAESI Act.
