The petitioners accused Nos.1, 2 and 3 are the brother-in-law and mother-in-law and the husband of the complainant. There is nothing in the summary of the charge sheet to indicate that there is even a modicum of offences that would become punishable under Sections 498A or 504 and 506 of the IPC, minor skirmishes or minor taunts between the husband and the wife is projected to become a crime. Permitting further trial in the case at hand would run foul of the Judgement of the Apex Court rendered on 16th April 2025 in the case of Kamal vs. State of Gujarat reported in 2025 INSC 504 / 2025 LiveLaw (SC) 440. Therefore, there shall be an interim order of stay of all further proceedings in C.C.No.896/2023 against the petitioners till the next date of hearing. List the matter on 06.06.2025.” 3. Learned Addl. SPP now submits that the charges have been framed way back in the year 2023, i.e., - 6 - HC-KAR NC: 2025:KHC:36383 CRL.P No. 3887 of 2025 long before the filing of the present petition. In the light of charges framed, I deem it appropriate to permit the continuance of the proceedings before the concerned court. 4. The learned counsel for the petitioners submits that the job opportunities of the first petitioner is jeopardized because of the pendency of subject petition. Therefore, the concerned court shall endeavor to conclude the proceedings within an outer limit of six months from the date of receipt of certified copy of this order, if not earlier.
