Parties are duly identified by their respective counsel. 2. The parties submit joint memo which reads as follows: JOINT MEMO The complainant and the accused humbly submit as follows: 1. On mutual discussion and negotiation, Complainant and the Accused have agreed that an amount of Rs. 4,25,000/- (Rupees Four Lakhs Twenty Five Thousand only), [out of which Rs. 1,87,005/- (Rupees One Lakh Eighty Seven Thousand Five only) has already been paid] shall be treated as full and final settlement for the above proceedings, in the following manner: - 3 - HC-KAR NC: 2025:KHC:28258-DB CCC No. 1043/2021 a. The Accused is undertaking before this Hon'ble Court that he will pay the remaining sum of Rs. 2,37,995/- (Rupees Two Lakhs Thirty Seven Thousand Nine Hundred Ninety Five only) on or before 31.10.2025, in the following manner: i) The Accused shall file an application in L.A.C. No. 50/2013, before the Ld. City Civil & Sessions Court, Bengaluru seeking an order for the release of the said sum of Rs. 2,37,995/- (Rupees Two Lakhs Thirty Seven Thousand Nine Hundred Ninety Five only), to the Complainant and make all efforts to secure the said amount to the Complainant. ii) However, if the said amount is not paid to the Complainant on or before 31.10.2025 through the aforesaid method in the said proceedings, the Accused undertakes to pay the said sum to the complainant on his own accord on or before 31.10.2025. b. The Accused shall co-operate with the Complainant to obtain the Provident Fund amount lying in the Complainant's Provident Fund account with the Provident Fund Department (by providing necessary documents and signing and submitting necessary authentication letters to the Provident Fund Department, etc.). However, it is clarified that the amount lying in the Complainant's Account with - 4 - HC-KAR NC: 2025:KHC:28258-DB CCC No. 1043/2021 the aforesaid department shall not be a liability of the Accused. 2. In view of the above undertaking, the Complainant and the Accused humbly pray that this Hon'ble Court may be pleased to take this joint memo on record and dispose the above case in terms of this joint memo, with liberty to the complainant to revive/file contempt case on failure of the above undertaking by the accused in the interest of justice and equity. 3. Both parties admit the execution of the joint memo and the terms therein. We are satisfied that the joint memo is executed voluntarily and steps are taken to complete compliance of order. 4. Therefore, recording the joint memo, this petition is disposed of, reserving liberty to the complainant to revive the same, in case of non compliance.
