Agrawal, Spl.P.P …..... 06/17.04.2025 This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 11(1)(D) of the Prevention of Cruelty to Animals Act and Sections 12 and 13 of Jharkhand Bovine Animal Prohibition of Slaughters Act in connection with Jama P.S. Case No. 61 of 2024, pending in the Court of learned CJM, Dumka. Heard learned counsel for the petitioner(s) and learned APP for the State at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. The petitioner is the driver of the vehicle, by which, the cattle was being transported illegally. Though it has been submitted that the owner and the person who were doing this business have been granted anticipatory bail, yet the case of the driver stands on different footing as he was the person, who was primarily responsible for loading and unloading of cattle in the vehicle. In view of the aforesaid facts, I am not inclined to allow this anticipatory bail application. Accordingly, the prayer for bail of the petitioner, above named, is rejected. However, if the petitioner surrenders, his case will be considered, considering the order by which, the other accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court in ABA No. 2298 of 2025 and ABA No. 7052 of 2024.
