Present petition under Section 483 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of bail pending trial to the petitioner in FIR No.113 dated 09.08.2024, registered under Sections 118(2), 118(1), 115(2), 191(3) read with Section 190 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’) at Police Station Cantonment, Amritsar. 2. Allegations are that petitioner along with other co-accused formed an unlawful assembly and in prosecution of their common object caused injuries on the person of de facto complainant-Gian Chand. 3. Contends that petitioner is in custody since 04.05.2025. Further contends that FIR was registered way back on 09.08.2024 but investigation ITHLESH KUMAR 2025.07.03 18:10 I attest to the accuracy and integrity of this order/judgment CRM-M-32146-2025 2 in the matter is still going on. Also contends that parties i.e. petitioner as well as de facto complainant have compromised the matter at their own level and in this regard a quashing petition (CRM-M-32315-2025) is pending consideration for 20.08.2025. 4. Per contra, learned State counsel, on instructions, duly acknowledged the above factual position; but he opposed the prayer on the ground that allegations are very serious. 5. Learned counsel for complainant acknowledges the factum of compromise and raises no objection in case present petition is allowed. 6. Heard both sides and perused the paper-book. 7. Concededly, petitioner is in custody since 04.05.2025. Moreover, it is not the objection raised by the State that in case petitioner is released on bail, he shall influence the witnesses or hamper fair trial in any manner. It is also discernible that matter has been amicably settled between the parties i.e. petitioner and de facto complainant and in pursuance thereof, quashing petition (CRM-M-32315-2025) on the basis of compromise has already been filed which is pending consideration for 20.08.2025. Therefore, further incarceration of petitioner would not serve any purpose. 8. Consequently, present petition is allowed; petitioner shall be admitted to bail on furnishing bail/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 9. Petitioner shall appear on each & every date of hearing and to fully co-operate with learned trial Court without seeking any unnecessary adjournment(s). 10. The above observations may not be construed as an expression of opinion on the merits of the case. 11.
