Augusta, learned counsel appearing for the applicant and Mr. Deepak Prasad Sahu, learned counsel appearing for the respondents. The present application had been filed with the prayer for recalling the order dated 07-02-2025 passed by this court in WP(C) No. 239 of 2024, by which the said writ petition was dismissed as being withdrawn. The prayer of the applicant is to recall the said order and to restore the said petition in file for hearing on merit. Mr. U. Augusta, learned counsel appearing for the applicant submitted that on 07-02-2025, two cases viz., WP(C) No. 239 of 2024 and WP(C) No. 228 of 2024 were listed together and the counsel for the petitioners made a prayer for allowing the petitioners to withdraw WP(C) No. 228 of 2024, however, through inadvertence, while recording the order passed by this court, it has been wrongly recorded in the file as WP(C) No. 239 of 2024. Mr. Deepak Prasad Sahu, learned counsel appearing for the respondents fairly submitted that he has no objection in allowing the present application. In view of the submission made by the learned counsel appearing for the parties and on perusal of the record, this court find sufficient ground for recalling the order dated 07-02-2025 passed by this court in WP(C) No. 239 of 2024. Accordingly, the said order is hereby recalled and WP(C) No. 239 of 2024 is restored on file. Registry is directed to list the said writ petition being WP(C) No. 239 of 2024 on 07-04-2025.
