2025:UHC:4448-DB IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL HON’BLE THE CHIEF JUSTICE SRI G. NARENDAR AND HON’BLE SRI JUSTICE ALOK MAHRA Habeas Corpus Petition No. 15 OF 2025 3rd June, 2025 Nirmal Singh @ Rajesh Kutal …… Petitioner Versus State of Uttarakhand and and Others …… Respondents Presence:- Mr. Rahul Consul, learned counsel for the petitioner. Mr. J.S. Virk, learned Deputy Advocate General for the State. --------------------------------------------------------------------- JUDGMENT: (per Hon’ble The Chief Justice Sri G. Narendar) Heard learned counsel for the petitioner and learned Deputy Advocate General for the State. 2. Learned Deputy Advocate General submits that respondent no. 4 and the corpus i.e. the daughter of the petitioner are married and they have preferred a petition for protection before the High Court of Punjab and Haryana. 3. It is fairly admitted by the learned counsel for the petitioner that the corpus is a major and keeping in view 1 2025:UHC:4448-DB the developments prior to the filing of the instant petition, we are of the opinion that the petition for habeas corpus would not survive and the fact remains that the petitioner is also arrayed as a party before the High Court of Punjab and Haryana. 4. In that view of the matter, the petition is disposed of, as it does not warrant any further orders. ________________ G. NARENDAR, C.J. ____________ ALOK MAHRA, J. Dt: 3rd June, 2025 Ujjwal 2
