JUSTICE HARISH KUMAR ORAL ORDER 2 27-08-2025 Heard the learned Advocate for the petitioners and the learned APP for the State. 2. The petitioners apprehend their arrest in connection with Arwal P.S. Case No. 160 of 2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 303(2), 109, 117(2), 352 and 351(2) of the B.N.S., 2023. 3. Allegedly, on account of some altercation, all the accused persons, including the petitioners brutally assaulted the informant and his family members. It is specifically alleged that

No.57212 of 2025(2) dt.27-08-2025 2/3 co-accused Alish @ Tigar assaulted the informant over his head by means of iron rod and further caused assault over the hand of his sister, leading to fracture injury. There is allegation of snatching of valuables worth Rs. 50,000/-. 4. Learned Advocate for the petitioners contended that with regard to an occurrence, which took place on 02.05.2025, the present FIR came to be filed on 05.05.2025, without there being any explanation for delay. Even as per the narration made in the FIR, specific allegation has been levelled against co- accused Alish @ Tigar, who is not before this Court. The Doctor has further examined the informant Rahul Kumar and his sister, however, the injuries have been found to be simple in nature. Both the parties are neighbours and now they have settled the dispute outside the Court. 5. On the other hand, learned counsel for the State opposed the pre-arrest bail application. However, learned Advocate for the informant reiterates the statements made by the learned Advocate for the petitioners. 6.
Having considered the submissions set-forth by learned Advocate for the respective parties and taking note of the delay in lodging of the FIR, coupled with the fair antecedent and the simple nature of injuries, let the petitioners above

No.57212 of 2025(2) dt.27-08-2025 3/3 named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Arwal (Jehanabad) in connection with Arwal P.S. Case No. 160 of 2025, subject to the conditions laid down in Section 482(2) Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners. shivank/- (Harish Kumar, J) U T
