A compromise petition in the form of joint application I.A.No.1/2025 is filed by petitioner/accused - 3 - HC-KAR NC: 2025:KHC:28644 CRL.P No. 9361 of 2022 No.1 and respondent No.2 under Section 482 r/w 320 of Cr.P.C. The terms and conditions of the compromise petition reads as under: "The Petitioner and Respondent No.2 herein most respectfully submit this Joint Compromise Application seeking compounding of the offences enumerated in the charge sheet filed by Respondent No.1 Police in S.C. No. 5014/2022, arising out of Crime No. 8/2021, registered against the Petitioner for offences punishable under Sections 498A, 307, 114, 504, 506, and 149 of the Indian Penal Code. The said case is presently pending adjudication before the Hon'ble III Additional District and Sessions Judge, Anekal, Bengaluru Rural District as below:- 1. The Petitioner is presently facing trial in S.C. No. 5014/2022 arising out of Crime No. 8/2021, registered against the Petitioner for offences punishable under Sections 498A, 307, 114, 504, 506, and 149 of the Indian Penal Code, which is pending adjudication before the Hon'ble III Additional District and Sessions Judge, Anekal, Bengaluru Rural District. 2. The Respondent No.2 had instituted Matrimonial Case No. 159/2023 before the Hon'ble Principal Judge, Family Court, Haveri, seeking a decree of divorce. During the course of her evidence, she deposed that she had amicably settled her disputes with the Petitioner. Consequently, a decree of divorce was passed, wherein she expressly consented to compound the aforementioned criminal case. 3. The Respondent No.2 is not inclined to pursue the criminal proceedings in S.C. No. 5014/2022, as the dispute has already been amicably settled. The matter is currently set down for hearing before charge (HBC). Respondent No.2 has agreed not to Press any Charges - 4 - HC-KAR NC: 2025:KHC:28644 CRL.P No. 9361 of 2022 against the petitioners as per the judgment and decree in MC NO. 159/2023. Consequently, the charges framed against the Petitioner have become infructuous and are liable to be compounded in the interest of justice. 4. The Petitioner humbly submits that the offences mentioned herein are compoundable with the leave of this Hon'ble Court, in terms of the law laid down by the Hon'ble Supreme Court in (2012) 10 SCC 303 (Gian Singh's case). 5. The petitioner humbly requests that this Hon'ble Court be pleased to be read the averments made in the main petition as part & parcel of this application to avoid repetitive averments. WHEREFORE, the Petitioner and the Respondent No.2 most humbly pray this Hon'ble Court be pleased to accept the joint compromise application and permit the Respondent No.2 to compound the offences against the petitioner in S.C. No. 5014/2022 in Crime No.8/2021 registered against the Petitioners herein for offence/s punishable u/s 498A, 307, 114, 504, 506, 149 of IPC, pending on the file of 3rd Addl. District and sessions Judge, Anekal, Bengaluru Rural District, in the ends of justice." 3. Respondent No.2/defacto complainant admit the compromise and submits that she has no objection to allow the petition and compound the offences. The terms and conditions of compromise petition are legal and - 5 - HC-KAR NC: 2025:KHC:28644 CRL.P No. 9361 of 2022 equitable. The same is accepted and accordingly, following: ORDER (i) The petition filed by petitioner/accused No.1 under Section 482 Cr.P.C is allowed. (ii) The criminal proceedings in S.C.No.5014/2022 (Cr.No.8/2021 of Suryanagar PS) on the file of III Addl.District and Sessions Judge, Anekal, Bengaluru Rural District, Bengaluru, for the offences punishable under Sections 498-A, 307, 114, 504, 506, 149 of IPC is hereby quashed.
