……Respondent(s)
CORAM : HON'BLE MR.JUSTICE SUMEET GOEL
Present:- Ms. Ridhi Bansal, Advocate for the petitioners.
Mr. Gurmeet Singh, AAG, Haryana.
Mr. Joginder S. Dhankhar, Advocate for the complainant. **** SUMEET GOEL, JUDGE
1.
Present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail to the petitioner in FIR No.0077 dated 23.02.2025 registered for offences punishable under Section 305 of BNS 2023 at Police Station Chandimandir, District Panchkula.
2.
On 11.06.2025, the following order was passed:-
“Apprehending her arrest in FIR No.0077 dated 23.02.2025 registered for offences punishable under Section 305 of BNS 2023 at Police Station Chandimandir, District Panchkula; the petitioner has preferred this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail.
Counsel for the petitioner, inter alia, contends that the petitioner is a lady aged about 53 years; the petitioner is related to the complainant-side and she is sought to be implicated NAVEEN NAGPAL 2025.07.03 17:34 I attest to the accuracy and authenticity of this order/judgment HIgh Court Chandigarh

primarily on the ground of suspicion & the petitioner is ready to join the investigation and cooperate therein.
Notice of motion.
On the strength of advance notice; Mr. Aashish Bishnoi, DAG, Haryana has entered appearance on behalf of the respondent-State of Haryana.
Adjourned to 03.07.2025.
The petitioner is directed to appear before the Investigating Officer on 16.06.2025 at 11:00 A.M. in concerned Police Station and join investigation. In the event of arrest, the petitioner shall be released on interim bail subject to her furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. She shall abide by the condition(s) enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.”
3.
Learned State counsel (on instructions from ASI Vikrant) has submitted that the petitioner has joined investigation but her custodial interrogation is required for effecting recovery of the stolen article(s).
4.
Learned counsel for the complainant has also vehemently opposed the grant of anticipatory bail to the petitioner by arguing that the allegations against the petitioner are serious in nature and until the recovery is not made, she should not be extended the benefit of anticipatory bail.
5.
Having heard learned counsel for the parties and upon perusal of the record; especially keeping in view the petitioner having joined investigation and the sole reason for which the dismissal of the petition in hand is being sought by the State is the recovery of the alleged stolen article(s), this Court deems it appropriate to confirm the order dated 11.06.2025.
6.
Accordingly, the petition is allowed and interim order dated 11.06.2025 passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) BNSS, 2023.
