Petitioner Sukhchain Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 341 dated 06.12.2024 under Sections 137(2), 96, 61(2) of BNS 2023, registered at Police Station Sohana, District SAS Nagar Mohali (Annexure P-1). 2. As per the facts of the case, complainant Manjit Singh stated that he is 73 years old and unmarried. He and his family are owners of properties worth crores in village Sohana and village Baladi, District Fatehgarh Sahib. The victim ‘S.K.’ and ‘J.K.’ (minor) are daughters of his brother Late Malkit Singh. Sukhchain Singh and his family were keeping bad eye on her niece ‘J.K.’ and they wanted to perform her marriage by giving allurement. On 20.11.2024, he went to sleep and in the morning, his neighbour Satinder Singh @ Vicky disclosed that some unknown persons have taken away both daughters of his brother at night time around 9.30 P.M. Learned counsel for petitioner argued that allegations levelled against him are false and without any basis. Elder niece of the complainant performed marriage against the wishes of complainant and approached this High Court seeking protection of their life and liberty by filing CRWP No.11362 of 2024 in which order was passed on 26-11-2024 (Annexure P-2). Similarly, younger niece of the complainant appeared in the Court and stated that she did not want to go home and as per the orders of JMIC, Mohali dated 18.02.2025 (Annexure P-3), she was produced before the Child Welfare Committee for appropriate orders. Without considering the aforesaid factual position, bail application filed by petitioner was wrongly declined by learned Additional Sessions Judge, SAS Nagar, Mohali vide order dated 13.02.2025 (Annexure P- 5). Vide order dated 11.06.2025, petitioner was granted interim relief and in pursuance of this, he has already joined the investigation. He is still ready to join the investigation as and when required. Therefore, his anticipatory bail petition may be allowed. 4. Learned counsel representing State filed a detailed status report confirming the facts narrated in the FIR. The facts narrated by the petitioner regarding appearance of victim before the court of JMIC, SAS Nagar, Mohali on 18.02.2025 is confirmed. Even elder niece of the complainant ‘S.K.’ also appeared before the Court on 19.02.2025. The investigation was completed. It is confirmed that petitioner has joined investigation in pursuance of orders passed by this court. Even co-accused Balbir Singh has joined investigation in compliance to the orders passed in CRM-M-33005-2025. On instructions of SI Gurdeep Kaur, it is submitted that petitioner is not required for further investigation. Considering the aforesaid factual position, no purpose would be served by sending the petitioner behind the bars. The merits of the case will be considered at appropriate stage. Petitioner has fully cooperated with the investigating agency. Therefore, anticipatory bail petition filed by petitioner Sukhchain Singh is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of BNSS, 2023. 6.
