SONI SHRIVASTAVA ORAL ORDER 2 29-08-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 127(1), 74, 109, 352, 3(5) of the BNS, 2023. 3. The allegation in the FIR lodged by the informant is that when she objected to her elder brother-in-law urinating in the lane, he hurled abuses and also indulged in assault and when her husband intervened, the other accused persons including her nephews, who are all petitioners, also indulged in assault. 4. Learned counsel for the petitioners submits that the incident has happened on account of a dispute between the parties
Patna High Court CR. MISC. No.56920 of 2025(2) dt.29-08-2025 2/2 who all belong to the same family and the dispute between them is with regard to property. It is further submitted that the injuries sustained by the informant are in the nature of pain and swelling and the same are simple in nature, as indicated in the injury report (Annexure P/2). It is also submitted that these petitioners have no criminal antecedent as mentioned in para 3 of the bail application. 5. Learned APP for the State, however, opposes the prayer for anticipatory bail. 6.
Considering the facts and circumstances of the case and also considering that the petitioners are gotiyas of the informant and the injuries are simple in nature, let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Chainpur P.S. Case No. 272 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023. divyanshi/- (Soni Shrivastava, J) U T
