1. Mr. Pragya Prakash Upadhyay, learned counsel for the applicant.
2. Mr. Himanshu Sain, learned Brief Holder for the State.
3. The present applicant ‘Dinesh Singh Airi’ S/o Late Ram Singh is praying for bail in relation to First Information Report dated 28.05.2024 bearing FIR No. 28 of 2024 P.S. Dharchula, District Pithoragarh, which was lodged by one Trilok Singh, the paternal uncle of the victim, implicating the applicant for the offence punishable under Section 307 of IPC.

It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and the victim infact is the wife of the applicant and there was some differences in between both of them though from this marriage there are the two children. He also submits that the charge-sheet has already been filed and there is no need of the custodial interrogation of the present applicant and the applicant is languishing in jail since 28.05.2024.
5. On the other side, learned State counsel have not disputed this fact that the charge-sheet has already been filed and the trial has already been commenced, therefore, at this juncture there is no need of the custodial interrogation of the present applicant.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the charge-sheet has been filed and the trial has been commenced therefore there is no need of the custodial interrogation of the present applicant and furthermore the applicant is languishing in jail since 28.05.2024, this court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.

8. Let the applicant ‘Dinesh Singh Airi’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
