Learned Additional Government Advocate accepts notice for respondent Nos.1 to 4. 2. Notice to respondent No.5 is dispensed with in view of the proposed order to be passed. 3. The petitioner is before this Court seeking for the following relief's: - 3 - HC-KAR NC: 2025:KHC:39596 WP No. 29098 of 2025 "a) Issue a writ of mandamus or any other appropriate Writ, direct the respondents No.1 and 2 take necessary action against the respondent No.5 by directing not arbitrarily interfere at the Pooja times in the temple and b) Grant such other relief or reliefs as this Hon'ble Court may deem fit to grant in the circumstances of the case, in the interest of justice and equity." 4. The contention of the petitioner is that there is a dispute between the petitioner and one Sri. N. Srinivasan, the younger brother of the petitioner, with regard to the Pooja activities to be conducted at the SLN Temple, Bhadravathi. In respect of the said dispute, a civil suit as well as a complaint in PCR No.108/2025 have been filed. 5. The submission of the learned counsel for the petitioner is that, though PCR No.108/2025 is pending, the police have interfered with the Pooja activities conducted by the petitioner. 6. Since a private complaint is already pending, it would be for the petitioner to seek such relief in those proceedings and a separate proceeding seeking for mandamus in the manner as sought for is not maintainable. - 4 - HC-KAR NC: 2025:KHC:39596 WP No. 29098 of 2025 7. Reserving liberty to the petitioner to seek such relief in PCR No.108/2025 pending before the II Additional Civil Judge and JMFC, Bhadravathi. 8. Accordingly, the writ petition stands disposed of.
