PUBLIC PROSECUTOR The Court made the following: ORDER:- The Criminal Petition, u/See.482 of B.N.S.S is filed on behalf of the petitioners/Al to A3 to grant anticipatory bail in connection with Crime No.107/2024 of Yemmiganur Rural Police Station, KurnooI District. 2) A case has been registered against the pet'ltioners herein for the offence punishable u/Secs.126(2), 109 r/w 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short lB.N.S'). \ 2 3) The brief facts-~of the case are that this is a case of wrongful restraint followed by an attempt to murder with common intention that occurred on 02.08.2024 at 10.00 hours at the fields of Malkapuram Village, Yemmiganur Mandal of KurnooI DI-Strict. There are ill-feelings between the husband of the defacto complainant and A2 with regard to sharing of Ac.1.00 cents of land of their father and in this regard on 02.08.2024 at about 10.00 a.m., when the defacto complainant along with her husband were returning home with chilly crop, and reached at a distance of 1 k.m. to the field, the accused had way-laid in the Vanka and when the defacto complainant and her husband reached the said place, the accused attacked them with pattudu sticks with an intention to kill her husband and beat him indiscriminately and caused bleeding injuries on the head and contusions on the hands and fracture injuries and when she tried to intervene, the accused pushed her aside and when she raised the cries, hearing the same, the neighbouring field owners Came there and On Seeing them, the accused ran away On motorcycle. Later, the injured` was shifted to the hospital for treatment. Basing on the complaint given by the defacto complainant a case in Crime No.107 of 2024 was registered and investigated into. ---I,y- ``, /\ 3 4) Heard. perused'ihe record. \'',\ i 5) As seen from the report, there were land disputes between the two groups. The learned counsel for the petitioners/Al to A3 subml.ts that, based on the jnjurl-es alleged to have been sustained by the de facto complainant, the case was regl-stered. However, they contend that the petjtI'Oners were not I'nVOIVed Ion the commission of the offence. consl-dering the fact that there are no antecedents against the petl-tioners, and given that there are cases land counter-cases between the parties, the possibl-lily of a false implication of the present petl'tioners cannot be ruled out. The learned Assistant public prosecutor brought to the notice of thl-s court that the victim sustained severe jnJ'urjeS. Considering the material on record, this court is not incII'ned tO grant antl'cipatory bail to Al and A2. 6) Accordingly, the anticipatory bail appII-CatiOn Of Petitioner Nos.1 and 2/Al and A2 is dI-SmiSSed and the anticipatory ba" applI'CatiOn Of 3rd petl'tioner/A3` is allowed.
