Mr. Gaurav Singh, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. The present applicant ‘Shahrukh’ is praying for bail in relation to First Information Report dated 04.04.2025 bearing FIR No. 151 of 2025 P.S. Kotwali Jwalapur, District Haridwar, wherein, the present applicant has been implicated for the offence punishable under Section 8/21 of NDPS Act. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the alleged contraband, which is shown to be recovered from the applicant is Smack, which is below a commercial quantity i.e. 16.10 gms and the applicant have no previous criminal history. 5. On the other side, on written instruction learned State counsel informs this court that the alleged contraband, which is shown to be recovered from the present applicant, is below a commercial quantity and furthermore the applicant have no previous criminal history. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration that the alleged contraband, which is shown to be recovered from the present applicant, is below a commercial quantity and furthermore since the applicant have no previous criminal history, this court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘Shahrukh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned. 2025:UHC:4361 9. It is made clear that after being released on bail the applicant shall report to the concerned police station in every month and the concerned SHO shall record his presence.
