The petitioner is aggrieved with the impugned orders dated 01.05.2025 and 27.05.2025 passed by the Settlement Officer of Consolidation, Maharajganj. The petitioner has a remedy of revision before the Deputy Director of Consolidation under the U.P. C.H. Act. Faced with this learned counsel for the petitioner submits that the petitioner is willing to avail the alternative remedy. However, he contends that he has been inconvenienced due to the non speaking interim order passed by the Settlement Officer of Consolidation, Maharajganj.
Learned counsel for the petitioner recasts his prayer and submits that he may be given an opportunity to file an application for interim relief before the Deputy Director of Consolidation which shall be decided in an expeditious time frame. Learned Standing Counsel does not have any serious objection to the aforesaid prayer.
In wake of the preceding discussions, the Deputy Director of Consolidation, Maharajganj shall decide the interim prayer/stay application by a reasoned order as per law within a period of one month from the date of receipt of a certified copy of this order along with a fresh copy of the representation after hearing all the parties. In case the stay application is not decided within the aforesaid period, the petitioner may approach the Court again and the concerned Deputy Director of Consolidation may be put to notice on the failure to decide the same as per law. The parties are directed to cooperate in the proceedings. With the aforesaid direction, the writ petition is disposed of.
