THIS CRP IS FILED UNDER SECTION 115 OF THE CIVIL PROCEDURE CODE, 1908 AGAINST THE JUDGMENT AND DECREE DATED 29.07.2015 PASSED IN S.C.NO.19/2011 ON THE FILE OF THE ADDL.SENIOR CIVIL JUDGE & JMFC, AT CHICKBALLAPUR, DECREEING THE SUIT FOR EVICTION.
THIS PETITION, COMING ON FOR ADMISSION, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER After addressing the arguments for some time, affidavit came to be filed by the petitioner.
2. Contents of the affidavit are reads as under:
“I, K S Suguna Shekar aged about 43 years, S/o. K.N. Shankaranarayana Shetty, R/O MNR Trust Building, Shidlaghatta Circle, B.B. Road, Chikkaballapura, today at Bengaluru, do hereby solemnly affirm and state on oath as hereunder:-
1. I am the petitioner No.1(c) in the top noted petition and I know the facts of the case. Hence I am swearing to this Affidavit on my behalf

and on behalf of the other petitioners also as they are my mother and brother.
2. I submit that, the top noted petition is filed challenging the Judgment and Decree dated 29.07.2015 in SC No.19/2011 passed by the learned Addl. Senior Civil Judge and JMFC at Chikkaballapur, there in we are directed to quit and deliver the vacant possession of the suit schedule property. I respectfully submit that I will quit and deliver the vacant possession of the suit schedule property within 30th of April, 2026.
3. Hence I respectfully pray that this Hon'ble Court to grant us time till 30th April, 2026 to quit and delver the vacant possession of the suit schedule property, in the interest of justice.”

Learned counsel for the respondents has endorsed no objection on the affidavit.
4. Placing the affidavit on record Civil Revision Petition stands dismissed.
5. However, time is granted to vacate the petition schedule premises is extended till the end of April 2026 on the condition that the petitioner shall pay the rent regularly as and when it accrues and without driving the respondent to file

execution petition and voluntarily vacate and hand over the premises.
