To direct the respondents to create Jamabandi of the petitioner after cancelling the entry made in the name of Anabad Bihar Sarkar in the Revisional Survey Entry for the raiyati land of the petitioner appertaining to P.S. Khata No. 36, R.S. Khata No. 66, 67 the land situated in Mauja Machiawan, Thana No. 845, Mauja- Patna High Court CWJC No.13646 of 2018(5) dt.04-02-2025 2/9 Madicha Thana No.853 and Mauja-Amao registered earlier in the name of ancestor of the petitioner namely Late Sheikh Hayat Ali. ii. To dispose of the representations filed by the petitioner before the respondent authorities in accordance with law. iii. To direct the respondent to issue rent receipt after creating Jamabandi in favour of petitioner and other heirs of Late Sheikh Hayat Ali. iv. To grant any other relief/reliefs for which the petitioner is entitled under the facts and circumstances of the instant writ application. 3. Learned Counsel for the petitioner submits that land appertaining to Cadastral Survey Khata No. 36, situated in Mauja Machiawan, Thana No. 845, Mauja- Madicha, Thana No. 853, and Mauja-Amao, was initially registered in the name of the ancestor of the petitioner, who was Khatiani Raiyats, whose name is also recorded in the Khawat of Revenue. Counsel submits that the C.S. Khatian was recorded in the name of ancestor of the petitioner, with the nature of the land mentioned as “Gairmajarua Malik”. Furthermore, Counsel states that the land has been in possession of the heirs of the Sheikh Hayat Ali, whose name is recorded in the C.S. Khatian. However, during Patna High Court CWJC No.13646 of 2018(5) dt.04-02-2025 3/9 the Revisional Survey, the land was erroneously recorded as “Anabad Bihar Sarkar”. Subsequently, a representation was submitted before the Circle Officer, Rampur, District- Kaimur, requesting for correction, but no action has been taken so far. Counsel further submits that the Cadastral Survey Khatian records and the said representation are annexed as Annexure- 2 and Annexure- 3, respectively. 4. Learned Counsel for the State submits that the petitioner has no right over the land, and his application is not maintainable. Counsel further submits that the petitioner has never filed any representation in this regard. 5. In the light of the submissions made, it transpires to this Court that the State of Bihar issued a letter dated 11.11.2014, outlining the methodology for recording a person’s name in the Raiyati Column, particularly, concerning lands classified as “Gairmajarua Malik” and “Gairmajarua Amao”. The said letter clearly states that it is the Collector who has the authority to pass orders in such matters. This Court is of the firm view that when the State has granted liberty for the entertainment of a representation in accordance with the methodology prescribed in the law, the petitioner should also be granted the same liberty and a reasoned and speaking order must be passed on the representation filed by the petitioner. 7. In this background, the writ petition stands Patna High Court CWJC No.13646 of 2018(5) dt.04-02-2025 9/9 disposed off, directing the petitioner to file a fresh representation in light of the aforementioned letter dated 11.11.2014 before the District Magistrate- cum- Collector, Kaimur at Bhabua, within 30 days from today, along with a copy of this order. Thereafter, the District Magistrate- cum- Collector, Kaimur at Bhabua, shall hear the petitioner and pass a reasoned and speaking order order within 90 days, considering the above-mentioned letter.
