Judgment Hon’ble Ravindra Maithani, J. (Oral) It is the claim of the petitioner that he is an affected person of Tehri Dam Project, but he has not been compensated and rehabilitated. Therefore, the petitioner seeks compensation and other reliefs pertaining to rehabilitation. 2. Heard learned counsel for the parties and perused the record. 3. Learned Senior Counsel for the petitioner would submit that the petitioner is an affected person of Tehri Dam Project; he has made various representations for compensation and rehabilitation, but he has not received any compensation or rehabilitation package. He would submit that, in fact, the Director, Rehabilitation, Tehri Dam Project, New Tehri is not taking any action despite communication dated 12.02.2025 of the Joint Secretary, Government of Uttarakhand Addressed to the Director, Rehabilitation, Tehri Dam Project, New Tehri (which is part of Annexure 9). 4. Learned State Counsel would submit that in survey-sheet No. 288, there were persons and joint compensation or rehabilitation 2 facilities have already been provided; if the petitioner has any dispute, that is with regard to other co-sharers; he is not entitled to any compensation as such. But, the learned State Counsel gives a statement that on communication dated 12.02.2025 of the Joint Secretary, Government of Uttarakhand addressed to the Director, Rehabilitation, Tehri Dam Project (which is a part of Annexure 9 to the writ petition), a decision shall be taken within a period of six weeks. 5. The Court takes on record the statement made by the learned State Counsel. 6. Learned Senior Counsel for the petitioner submits that the petitioner may also be afforded an opportunity of hearing before taking any decision. 7. In view thereof, the writ petition is disposed of with the direction to the respondent no. 3/Director, Rehabilitation, Tehri Dam Project, New Tehri to take a decision on the communication dated 12.02.2025 of the Joint Secretary, Government of Uttarakhand (which is a part of Annexure 9 to the writ petition) within a period of six weeks from today, after affording an opportunity of hearing to the petitioner.
