The petitioner, through the medium of the instant petition, is seeking implementation of Order dated 08.04.2009, passed by the Writ Court, whereby a direction was issued to the respondents to consider the case of the petitioner in terms of the directions, dated 20th of May 1997, while keeping in view the fact that he is performing his duties as Headmaster since 1985 till date. 02. The respondents have filed the Compliance Report in which it has been submitted that case of the petitioner was considered and he was not found fulfilling the requisite criteria fixed by the Government for his regularization as Headmaster, as he is not an Officer from Army, which is prerequisite as per the laid-down criteria. 03. Heard and considered. 04. The respondents in their Compliance Report have clearly submitted that the petitioner had already attained the age of superannuation and they have further submitted that the petitioner does not fulfil the criteria fixed by the Government for his regularization as Headmaster. Once the respondents have accorded consideration to the case of the petitioner, the order of the Writ Court stands complied. If the petitioner has any grievance against the said order passed by the respondents, he is at liberty to challenge the same by way of appropriate proceedings. The validity of the consideration order cannot be a subject matter of determination in these proceedings. 05. In view of the above, the contempt proceedings are accordingly closed, leaving it open to the petitioner to challenge the action of the respondents. 06. Disposed of.
