THIS REVIEW PETITION UNDER ORDER 47 RULE 1 R/W SECTION 114 OF CPC, PRAYING TO ORDER FOR REVIEW THE IMPUGNED ORDERS PASSED ON 24/01/2022 IN WP NO.
1081/2018 (S-RES) ON THE FILE OF THIS COURT TO THE STAGE OF ARGUMENTS FOR THE PETITIONER ON MAIN PETITION IN WP NO. 1081/2018 (S-RES) AND ETC.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD ORAL ORDER
1. This review petition is filed by the petitioner under
Order XLVII Rule 1 read with Section 114 of CPC seeking to review the
order dated 24.01.2022 passed in W.P.No.1081/2018.
2.
Learned counsel for the petitioner has submitted that at the time of the death of the father of the petitioner, the petitioner was aged 4 years 8 months. After he attained majority, he has filed the application dated 09.11.2017 seeking appointment on compassionate

ground. Therefore, there is no delay in filing the application by the petitioner.
3. As per LIC Recruitment (of Class III and Class IV Staff) Instructions, 1993, which has been extracted in the
order passed in W.P.No.1081/2018, it is very clear that if the petitioner was a minor at the time of death of his father, he has to file an application seeking for appointment on compassionate grounds within three years from the date of death of his father. The petitioner’s father died on 21.01.2004. At the time of death of his father, the petitioner was a minor aged 4 years 8 months. The petitioner has filed the application on 09.11.2017 seeking appointment on compassionate ground, after lapse of 12 years from the date of death of his father. Therefore, the respondent has rightly rejected the application filed by the petitioner and issued the endorsement dated 28.11.2017.
4. In view of the above, this Court has rightly dismissed the writ petition. There is no error apparent on

the face of the record. Hence, no good grounds are made out to review the order. Accordingly, the review petition is dismissed both on the ground of delay as well as on merit.
5. All pending I.As. in this petition, if any, are dismissed accordingly.
