1. This order shall dispose of aforesaid two petitions filed under Section 483 BNSS and Section 439 Cr.P.C. for grant of regular bail to the petitioners in case FIR No.300 dated 17.11.2023, under Sections 302, 120-B IPC and Sections 25, 27, 54 & 59 of the Arms Act, 1959, registered at Police Station Jandiala, District Amritsar Rural.

The case of the prosecution is that the complainant Lovepreet Singh made a statement to the police that on 16.11.2023 at about 8:00 p.m., his father ASI Sarup Singh received a phone call from an unknown person and had an altercation over the phone. At about 8:45 p.m., his father left the house and thereafter he did not return until 9.30 p.m. and his phone was found to be switched off. Thereafter, the complainant searched for his father. On the next morning, he found him lying on the link road leading from Daburji to Village Khankot and his Activa was also found nearby. The deceased had suffered bullet injuries on his head. The case was registered as a blind murder case. Lateron, in supplementary statement, it was alleged that the petitioner Karan Singh who is stated to be the brother of one Harpal Singh @ Palo and petitioner Sucha Singh who is stated to be the father of Harpal Singh @ Palo in conspiracy with each other had committed the murder of the father of complainant.

Learned counsel for the petitioners submit that the petitioners have been falsely implicated in the present case and they have not committed any offence. The petitioners have been nominated only on the basis of disclosure statement suffered by the co-accused. He further submits that the petitioners were not present at the spot. The petitioner Karan Singh is in custody since 18.11.2023 and petitioner Sucha Singh is in custody since 17.11.2023. 4. Learned State counsel has filed the custody certificate of petitioner Karan Singh in the Court today and the same is taken on record. As per custody certificate, the petitioner Karan Singh is in custody for the last 01 year 09 months and 22 days. The petitioner Sucha Singh is in custody since 17.11.2023. Investigating Officer namely ASI Rashpal Singh, who is present in Court today, has stated that apart from the disclosure statement of co-accused Sharanjeet MAMTA MALHOTRA 2025.09.17 17:08 I attest to the accuracy and authenticity of this order/judgment Chandigarh
CRM-M-32035-2025 3 Singh, who has named the present petitioners, there is no other evidence on record to connect the present petitioners with the crime. 5. I have heard the learned counsel for the parties and perused the record. 6. Keeping in view the facts that the petitioners are in custody for a period of more than 01 year 09 months and 22 days as on today; apart from the disclosure statement there is no other evidence against the petitioners to connect them with the crime and although the challan has been presented but the trial is yet to commence, this Court deems it a fit case to grant the concession of regular bail to the petitioners during the pendency of the trial. 7. Therefore, without expressing any opinion on the merits of the case, the instant petitions are allowed. The petitioners are ordered to be released on regular bail on their furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 8. It is clarified that if on bail so granted through the instant order, the petitioners are found indulging in any other criminal case it shall be open to the State to seek cancellation of their bail. 9. Pending application(s), if any, shall also stand disposed of.
