JUSTICE MANASH RANJAN PATHAK ORDER 20-02-2025 Heard Ms. A. Medhi, learned counsel for the petitioners and Mr. M. P. Goswami, learned Additional Public Prosecutor, Assam for the State. 2. The petitioners, namely, (1) Hafiz Yasiruddin, son of Md. Islaoddin, resident of village-Lilong Haoreibi, Turel Ahanbi, P.S.-Lilong, District-Thoubal, Manipur and (2) Baseimayum Hasnel, son of Basei Hesamuddin, resident of village-Lilong Haoreibi, Makha Leikai, P.S.-Lilong, District-Thoubal, Manipur have filed this application under Section 483 BNSS, 2023, on 04.02.2025 seeking bail in Guwahati GRPS Case No.255/2024 corresponding to G.R. No. 7510/2024 registered under Sections 21(b)/29 of the NDPS Act, wherein they were arrested on 22.12.2024 and are in custody since then. 3. Matter relates to recovery of 114 grams of suspected heroin in 9 numbers of packets from the conscious possession of the petitioners during checking at Train No.22504 DN Kanniyakumari Vivek SF Express at Platform No.4 of the Gauhati Railway Station on 22.12.2024 at around 08:03 am in the morning. 4. It is submitted that since 22.12.2024 the petitioners are in custody and they have already completed the statutory period of 60 days in custody today and that the prosecution has not filed any charge sheet in the case till date. 5. On being enquired, Mr. Goswami, learned Addl. PP, Assam submitted that the case diary is with him and the charge sheet in said Guwahati GRPS Case No.255/2024 has not been filed till date. Page No.# 3/4 6. Since 22.12.2024, the petitioners are in custody till date for about 60 days. In view of the above, the petitioners are entitled for their default bail in said Guwahati GRPS Case No.255/2024. 7. Accordingly, the petitioners, namely, (1) Hafiz Yasiruddin, son of Md. Islaoddin, and (2) Baseimayum Hasnel, son of Basei Hesamuddin are granted default bail in said Guwahati GRPS Case No.255/2024 on furnishing a bail bond of Rs. 1,00,000/- each with two local sureties each of the like amount, to the satisfaction of the learned Special Judge (NDPS), Kamrup (Metro), Guwahati on conditions that the petitioners – (i) shall appear before the Investigating Officer of said Guwahati GRPS Case No.255/2024 as and when they are required for necessary investigation of said Guwahati GRPS Case; (ii) shall surrender their passports, if any, before the learned Special Judge (NDPS), Kamrup (Metro), Guwahati on or before 28.02.2025; (iii) shall not leave the territorial jurisdiction of the learned Special Judge (NDPS), Kamrup (Metro), Guwahati, without obtaining prior written permission from the said authority; (iv) shall not hamper with the investigation or tamper with the evidence of the case; (v) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer and further (vi) shall not indulge themselves in any such criminal activities including possession or procurement of such NDPS items, failing which, the bail granted to them in said Guwahati GRPS Case No.255/2024 shall stand automatically vacated. 8. Any violation of the aforesaid terms and conditions by the petitioners, named above, the bail granted to them in the aforementioned Guwahati GRPS Case No.255/2024 shall stand automatically vacated.
