This petition under Section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023) has been filed seeking direction to the official respondent(s) not to harass the petitioner on the basis of fresh complaint bearing No.2438-PGD dated 12.09.2024 filed by respondents No.5 to 7 against the petitioner on the same allegations which have already been inquired by senior police officials and closed vide fact-finding report dated 25.04.2024 and legal opinion dated 19.07.2024 declaring the dispute to be purely civil in nature and already pending in a competent civil Court.

At the very outset, learned counsel for the petitioner has submitted that the petitioner has filed a representation dated 26.05.2025 (Annexure P5) before respondent No.4 raising his grievances as mentioned in the present petition but the same has not yet been considered and no action has been taken thereupon. He further submits that at this stage, the petitioner would be satisfied if, appropriate directions are issued to respondent No.4, to consider and decide the aforesaid representation filed by the petitioner and to take necessary action thereupon. Served with an advance copy of the petition, Mr. Luvinder Sofat, Senior DAG, Punjab, accepts notice on behalf of respondent(s)-State and submits that the needful will be done in due course.

In view of the limited prayer made by the petitioner and without commenting on the merits of the case, the present petition is
disposed of at this stage with a direction to respondent No.4 to consider and decide the aforesaid representation dated 26.05.2025 (Annexure P5) of the petitioner expeditiously, by passing a speaking order in accordance with law.

Needless to say, if any threat perception is found to the petitioner, the official respondents would provide him adequate security in
order to protect his life and liberty. Pending miscellaneous application(s), if any, also stands
disposed of.
