Sikdar, learned counsel for the petitioner, upon instruction has submitted that during the pendency of the contempt petition, the petitioner namely Ashak Ali has been released. Payeng, learned standing counsel for the F.T. matters was requested to look into the matter, and he has also stated that the petitioner has been released from the custody. 3. Before closing the matter, having noted that the opinion rendered by the learned Member Foreigners’ Tribunal No.7th, Barpeta in Case No. FT-354/17, corresponding to R/Case No.8720/98, was set aside by this Court, yet the respondent was taken into custody and he has been sent to the Transit Camp, Matia, Goalpara. The respondent shall be well advised to be cautious in taking action in those cases where by judicial orders, the opinion of Tribunal has been set aside. 4. The learned standing counsel for the Home & Political (B), Department shall transmit this order to the appropriate/ competent authorities so that they can devise a way that the order of the Court is brought to the notice of the concerned Superintendent of Police (Border).
