This order shall dispose of CRM-M-73555-2025, CRM-M- 1694-2026, and CRM-M-9466-2026, as all the petitions are interconnected and have arisen out of same FIR. However, the lead case is CRM-M-73555- 2025. 2. The instant petitions have been filed under Section 483 of JAWALA RAM 2026.05.16 12:42 I attest to the accuracy and authenticity of this document CRM-M-73555-2025 & CONNECTED CASES - 2 - BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioners, during the pendency of trial, who have been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No. Date Section(s) Police Station District Rahul (petitioner in CRM- M-73555-2025) 290 14.05.2025 S. 22(c) of NDPS Act, 1985 Suraj Kund Faridabad Ibrahim @ Raju (petitioner in CRM- M-1694-2026) 290 14.05.2025 S. 22(c) of NDPS Act, 1985 (S. 29 of NDPS Act, added later on vide Challan dated 28.10.2025, which was wrongly dismissed vide impugned order dated 16.12.2025) Suraj Kund Faridabad Boby Sharma (petitioner in CRM- M-9466-2026) 290 14.05.2025 S. 22(c) & 29 of NDPS Act, 1985 Suraj Kund Faridabad 3. As per allegations, while police party was on patrolling duty, a secret information was received that one Boby Sharma (petitioner in CRM- M-9466-2026) was about to arrive at a particular place carrying a huge quantity of narcotic substance and that in case a raid was conducted, he could be apprehended. On receipt of the said information, a naka was laid and when accused/petitioner – Boby Sharma reached there on a TVS motorcycle bearing registration No.DL11-PH-1101, he was apprehended. Upon search, 24,000 capsules of Tramadol were recovered from the boxes carried by him in a bag. In his disclosure statement dated 14.05.2025, accused/petitioner – Boby Sharma, who is stated to be about 18 years of age, disclosed that he was working as an employee in “Vaishno Pharma”, owned by co-accused – Ibrahim @ Raju (petitioner in CRM-M-1694-2026), and that on the instructions of the said co-accused, he was carrying the Tramadol capsules for delivery to a person at Faridabad Bus Stand having mobile JAWALA RAM 2026.05.16 12:42 I attest to the accuracy and authenticity of this document CRM-M-73555-2025 & CONNECTED CASES - 3 - No.8510838739. Thereupon, during investigation, co-accused/petitioner – Ibrahim @ Raju was arrested on 14.05.2025 itself and after his arrest, he also disclosed the name of his associate in running Vaishno Pharma, namely, Rahul. It was further disclosed that both of them were jointly dealing in intoxicant capsules by investing money in the said business. Consequently, on the basis of disclosure statement dated 14.05.2025 suffered by accused/petitioner – Ibrahim @ Raju, co-accused – Rahul (petitioner in CRM-M-73555-2025) was also nominated as an accused in the present case. After arrest of co-accused/petitioner – Rahul, another accused namely, Rajnish Sharma, was also arrested, who, as per the prosecution version, was supplier of the intoxicant capsules to Vaishno Pharma on receipt of payment. Accordingly, petitioners herein have filed present petitions under Section 483 of BNSS, 2023, seeking concession of regular bail on the ground that they have remained inside jail for a period of more than one year. 4. At this stage, without addressing much on merits, learned counsel appearing for petitioner – Boby Sharma (in CRM-M-9466-2026) seeks withdrawal of the regular bail petition qua him. Accordingly, regular bail petition qua petitioner – Boby Sharma, i.e., CRM-M-9466-2026, stands dismissed as withdrawn, at this stage. 5. From the case of prosecution and also from the status report dated 13.05.2026 filed by learned State counsel in Court today, it prima facie emerges that a huge quantity of Tramadol capsules was being transported from Vaishno Pharma through accused/petitioner – Boby Sharma, for delivery to someone at the Railway Station. 6. During investigation, as also detailed in the aforesaid status JAWALA RAM 2026.05.16 12:42 I attest to the accuracy and authenticity of this document CRM-M-73555-2025 & CONNECTED CASES - 4 - report, it has surfaced that accused/petitioner – Ibrahim @ Raju (in CRM-M- 1694-2026) is holding a licence to run a chemist shop and that co- accused/petitioner – Rahul (in CRM-M-73555-2025) had also invested money in the said business. As per the status report, an amount of Rs.1,33,294/- was transferred by him into the GST account of Vaishno Pharma through 10 UPI transactions on different dates. Another payment of Rs.37,400/- was also allegedly made by accused/petitioner – Rahul into the account of co-accused – Rajnish Sharma, who, in turn, used to supply the intoxicant capsules to Vaishno Pharma. 7. Keeping in view the fact that a huge quantity of Tramadol capsules has been recovered and prima facie involvement of accused/petitioner – Rahul (in CRM-M-73555-2025) as well as accused/petitioner – Ibrahim @ Raju (in CRM-M-1694-2026) in the alleged business is made out, this Court does not find any substantial reason to entertain their prayer for grant of regular bail at this stage. Accordingly, finding no merit in the aforesaid both petitions, same stand dismissed, at this stage. Pending misc. application(s), if any, also stand disposed of.
