1. Prayer in the instant civil writ petition filed under Articles 226/227 of Constitution of India is for issuance of a writ in the nature of mandamus for directing respondent No. 3 to issue passport to petitioner. 2. Apparently, petitioner has been convicted in case FIR No. 106, dated 28.08.2013, under Sections 279, 304 A IPC at Police Station Mukerian, District Hoshiarpur, and presently a criminal revision petition (CRR-2228-2022) titled as 'Tarsem Singh alias Sema Versus State of Punjab' against conviction of petitioner is pending consideration before this Court. It is submitted that petitioner has applied for issuance of a passport, however, same has not been issued till date. 3. At this stage, Ms. Amrita Singh, Advocate appears on behalf of respondents No. 1 and 3 on a copy of petition having been served upon respondent-Union of India and submits that in pursuance to application submitted by petitioner, certain information/clarification/documents were sought from petitioner by Regional Passport Office, Jalandhar, vide letter dated 15.012024 (Annexure P-3), however, he did not respond to the same SANJIV KUMAR SHARMA 2025.07.04 12:00 I attest to the accuracy and integrity of this document

2025:PHHC:077355 and consequently, application for issuance of a passport submitted by petitioner already stands closed. She further submits that in case, petitioner applies afresh for issuance of passport alongwith requisite information/clarification/documents, then said application would be considered by passport authorities and final decision shall be rendered thereon in accordance with law. 4. Keeping in view the aforesaid stand taken by learned counsel for respondents No. 1 and 3, this petition is disposed of by granting an opportunity to the petitioner to apply afresh for issuance of passport within a period of three weeks from today. 5.
It goes without saying that in case petitioner submits an application for issuance of a passport alongwith relevant documents within a period of three weeks from today, same shall be considered by passport authorities within a period of eight weeks from the date when such application for issuance of a passport is submitted by petitioner. 6. Pending application (s), if any, shall also stand closed. (HARSH BUNGER)
