The present appeal is directed against order dated 03.04.2023 passed by the Court of Additional District Judge (Fast Track), Budgam (for short “the trial court”) in case titled “Abdul Rahim Dar v. Abdul Majeed Sheikh and Ors”, whereby the communication dated 14.02.2023 issued by defendant No.2 (respondent No.1 herein) was stayed till disposal of the main suit. 2. Learned counsel for the respondents has produced a copy of order dated 18.09.2023 passed by the trial court, wherein it is stated that in view of the compromise arrived at between the parties, the suit came to be withdrawn by respondent No.1 (plaintiff therein). It is accordingly submitted that in terms of order dated 18.09.2023, the present appeal has been rendered infructuous. 3. It is noticed that there has been no representation on behalf of the appellant on the last two consecutive dates of hearing, and none appears today as well. It thus appears that, in view of the order dated 18.09.2023, the appellant does not intend to pursue the instant appeal. 4. In the above backdrop, the appeal is dismissed for non-prosecution.
