The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to modify the order dated 07.09.2022 passed by Additional Principal Judge Family Court, No. 3 Aligarh, whereby Rs. 4,500/- per month to the applicant no. 1 and Rs. 1,500/- per month to applicant no. 2 from the date of filing of the applicant under Section 125 of Cr.P.C. has been awarded against the opposite party no. 2. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
