HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 19500 of 2024 Court No. - 6 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. Heard Sri Siddharth Agrawal, learned Advocate holding brief of Sri Ishir Sripat, learned counsel for the petitioner and Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State respondents. The present petition has been filed seeking to assail an order dated 18.12.2023 as amended by a subsequent order dated 2.1.2024, passed by the respondent no.3, the Sub Divisional Magistrate, Handia, District - Prayagraj, under Section 38(1) of the U.P. Revenue Code, 2006. The petitioner has sought to assert that the aforesaid order has been passed ex parte against the petitioner. Counsel for the petitioner after making submissions to some extent has however not disputed that the order under Section 38(1) of the U.P. Revenue Code, 2006 would be subject to a further statutory legal remedy. Also in the event the order is ex parte, it would be open to the petitioner to seek its recall before the authority concerned. Having regard to the aforesaid, the present writ petition would not be entertainable at this stage. Accordingly, the petition is disposed of leaving it open to the petitioner to take recourse to the appropriate legal remedy, as he may be advised. Office to return the certified copies of the orders to the counsel for the petitioner, after retaining the photostat copies thereof. October 10, 2025 Arun K.
